Terms & Conditions | Warranties TERMS AND CONDITIONS FOR THE PURCHASE OF PUMPS AND FIBERGLASS WATER STORAGE TANKS Firewater Systems products are custom built to order, and are non-returnable. The purchaser is required to make sure that all ordering data, physical and outlet sizes, weights, and application suitability are correct prior to submitting a purchase order. Certain tank models are shipped in sections while others are shipped fully assembled. If the purchaser desires adjustments in specifications they should be communicated to our office in advance, and also clearly appear on the written purchase order. Clear and concise delivery instructions are to appear on each purchase order. No PO Box addresses are permitted. Note that job site deliveries may require that additional manpower or equipment may be necessary by the purchaser to off load tanks and pumps. No verbal product orders will be accepted. Fax purchase orders are satisfactory. Standard terms of payment are 50% with purchase order and the balance and freight costs payable upon receipt. VISA and MASTERCARD payments are accepted. Freight terms are FOB Alberta, Canada for tanks, and Harrisburg, PA for pumps. Payments terms of Net 30 Days are available for established and approved customers. Inquire with our office for details. All sales shipped to, or to be installed within The Commonwealth of Pennsylvania are subject to an additional 6% sales tax. The purchaser is responsible for indicating same on purchase order. Non-taxable purchasers must supply a current tax exempt certificate with purchase order. Should formal collection action be necessary to obtain payment additional costs and fees as well as interest at 1 1/2% per/mo. will be added to the sum due. All materials shipped remain the property of Firewater Systems, Inc. until all invoices are paid in full. Firewater Systems, Inc. office hours are weekdays, 8:30AM to 4:30PM, EST. FIREWATER SYSTEMS LIMITED WARRANTIES Firewater Systems, Inc. warrants, to the original owner, from the date of installation, at the original installation location, that the product will be free from defects for the following periods. Pumps / 1 year, Tanks / 5 years. This warranty is expressly limited to the repair or replacement of any part found to be defective under conditions of normal use and does not extend to liability for incidental, special, freight, or consequential damages or losses such as loss of time. No warranty applies to merchantability or fitness for any particular purpose. The purchaser is responsible for obtaining all necessary approvals, permits, and acceptances where required. There are no warranties, expressed or implied, which extend beyond the face of this warranty. Some states do not allow the exclusions or limitations of incidental or consequential damages. Failures resulting from misuse, improper installation, or design, or lack of maintenance are not covered by this warranty. In no event shall Firewater Systems, Inc. liability hereunder exceed the material replacement cost of the product component found to be defective. Warranty claims shall be submitted in writing, including photos of defective part(s) if possible. Include proof of purchase, installation location, date of installation, and installing contractor. The "Purchaser" is fully responsible for insuring that all products supplied by Firewater Systems Inc. are acceptable / approved by the "Authority Having Jurisdiction" prior to ordering our products.
